Exactly how illegal is it to sample pieces of released records and, maybe more importantly, how likely are you to get caught? Cause there are loads of distributed artists who do it (especially in the hip hop scene) so how do they get past these rules.
I know we can't post songs containing samples here, but are you allowed to post these kind of songs on, for example, myspace?

artists usually pay for those rights. if you pay for the rights, i'm pretty shure you can put your song anywhere you want.

Simple answer: no you are not allowed. the chance you get caught is small but gets bigger as you put information in your lyrics/song title/description about copyrighted material. don't be fooled by bad ass hiphop stars who sample stuff. Their management pays the fees like good little choirboys...

someone tried to tell me once you could use up to 3sec of copyrighted material without paying fees... i wonder if this is true?

You also have the public domain legislation etc.
AFAIK the info is clearly online on the sabam website what's allowed and not, rulings, fees, etc.
But really it mostly becomes a problem when you release it or use commercially. And myspace is a world in itself, putting up a remix not allowed on there will max. make your account get deleted, that's it.

hm kut-laws, no one ever paid for the amen break... :pThat's a sample too but it's like there's an unwritten law that it's an exception for the use of the amen break (or other breaks)And in the intro of squarepusher's come on my selector for example, there's a sampled break too, did he pay for the rights of the song? nee toch? of wel?
